Influencer marketing

We are excited to collaborate with you as an influencer for Bookmark Resorts. These terms and conditions outline the expectations, responsibilities, and benefits of participating in an influencer collaboration with Bookmark Resorts. By agreeing to the collaboration, you agree to follow these terms and the brand guidelines shared for the campaign.

At Bookmark Resorts, we believe in meaningful travel experiences and authentic storytelling. We value creators who can bring a destination, its surroundings, and the experiences it offers to life through engaging and honest content.

These terms are intended to support a mutually beneficial partnership and help us create memorable stories that inspire people to discover Bookmark Resorts.

Terms and Conditions

• The collaboration will commence on the date of the agreement and will continue for the duration specified in a separate agreement or email communication.
• If either party wishes to change the date or timeline for the collaboration, they must provide written notice to the other party with a minimum of 7 days prior notice, subject to mutual agreement.
• If there is a need to change the number of guests included in the agreement, the influencer must provide the resort with prior notice. The parties will mutually agree upon any additional costs or adjustments to the agreement.
• Compensation for the collaboration will be outlined in a separate agreement or email correspondence.
• Compensation, if applicable, will be detailed in the campaign brief and may include monetary payments, complimentary stays at Bookmark Resorts properties, or other mutually agreed-upon forms of compensation.
• In the case of barter deals, the influencer shall receive the agreed-upon products or services from Bookmark Resorts in exchange for the promotional services rendered.
• Bookmark Resorts will not be responsible for any expenses incurred by the influencer unless explicitly agreed upon in writing.

Deliverables and Expectations

• The influencer agrees to collaborate with Bookmark Resorts by creating and publishing content on social media platforms and other agreed-upon channels.
• The influencer’s content may include but is not limited to, reviews, recommendations, and promotional materials related to Bookmark Resorts and the agreed property or destination.
• Both parties will agree upon the specific content, scope, and deliverables before the collaboration.
• The influencer is required to share all pictures and videos taken during the collaboration within one week of departure.
• The influencer shall provide the agreed deliverables in the formats and by the dates set out in the campaign brief or separate written agreement.
• The influencer shall provide campaign performance screenshots and post links within seven (7) calendar days of each post going live, unless another timeline is agreed in writing.

Required Consents and Permissions

• The influencer will follow Bookmark Resorts’ content guidelines and policies regarding the use of its trademarks, logos, and copyrighted materials.
• The influencer shall not disclose any confidential information provided by Bookmark Resorts during or after the collaboration without written consent.
• The influencer is responsible for obtaining the necessary permissions and releases from any identifiable individuals featured in content, where required, and for ensuring that third-party music, images, footage, artwork, or other materials used in the content are appropriately licensed for the intended use.
• The influencer shall disclose the collaboration, including any complimentary stay, gift, payment, or other material benefit, in accordance with applicable law and the rules of the relevant social media platform.
• Any filming or photography in restricted, private, guest-sensitive, or staff-only areas must be approved in advance by the resort’s authorised representative.

Content Usage Rights and Licensing

• The influencer grants Bookmark Resorts a non-exclusive, royalty-free, worldwide licence to use, reproduce, distribute, modify, and display the content created for the campaign for promotional purposes across all media platforms and channels.
• Bookmark Resorts retains ownership of intellectual property or materials provided to the influencer during the collaboration.
• Bookmark Resorts reserves the right to use, reuse, and repurpose the content for marketing, advertising, promotional, or public relations purposes without the need for additional permissions or compensation to the influencer.
• The parties should confirm in the campaign brief whether any usage restrictions, creator credit requirements, paid-media usage limits, or time limits apply to a specific collaboration.

Posting Guidelines and Brand Compliance

• Dual branding on content created as part of the Bookmark Resorts collaboration is not permissible unless approved in writing.
• The influencer agrees to create accurate, honest content aligned with Bookmark Resorts’ brand values and guidelines. The influencer shall not create defamatory, offensive, or misleading content.
• The influencer shall tag and mention Bookmark Resorts and the relevant property in all relevant social media posts and provide appropriate credit in blog posts, photographs, or other forms of content created under the agreement.
• Bookmark Resorts retains the right to review and approve all campaign content before publishing or using it for promotional purposes. The influencer shall provide requested revisions and edits promptly.
• The influencer shall publish content only on the agreed platforms, using the agreed tags, mentions, campaign hashtags, location tags, and disclosure labels specified in the campaign brief.
• Unless otherwise agreed in writing, the influencer must obtain Bookmark Resorts’ approval before publishing campaign content.

Reporting, Tracking and Performance Metrics

• The influencer shall share the live URLs of all campaign posts and stories, along with available performance insights, within seven calendar days of posting or within another timeline agreed in writing.
• Where available on the relevant platform, performance reporting may include reach, impressions, video views, watch time, likes, comments, shares, saves, link clicks, and audience engagement.
• The influencer shall provide genuine platform-generated analytics or screenshots and shall not knowingly misrepresent, alter, or fabricate campaign performance data.
• Any additional tracking links, campaign codes, UTM parameters, or reporting formats must be agreed upon in writing before the campaign begins.

Cancellation, Non-Compliance and Dispute Resolution

• If either party wishes to cancel the collaboration, they must provide written notice to the other party as soon as possible. If the collaboration has already begun, any agreed-upon compensation or deliverables will be prorated based on the work completed.
• Either party may terminate the agreement with written notice if the other party breaches any material term or condition outlined herein.
• Termination of the agreement does not relieve either party of any obligations accrued before the termination.
• Non-compliance, missed deliverables, or alleged breaches will be reviewed case by case. Bookmark Resorts may discuss corrective action, a revised timeline, or termination as appropriate to the circumstances and any applicable agreement.
• Any dispute arising from a collaboration should first be referred to the designated representatives of both parties for resolution through good-faith discussions. If unresolved, the parties may pursue remedies available under applicable law. The governing law is intended to be India; the specific court jurisdiction must be confirmed and approved by legal counsel before publication.
